Hearing Brief
A Hearing Brief must be provided for all disability hearings. If there are numerous medical records pertaining to a claimant this will help the Of Counsel attorney to focus on the key elements of evidence and provide the best argument on behalf of the claimant. Hearing briefs are also mandatory for a number of judges across the country. Assure Disability can be hired by the firm to write a brief for the hearing or the firm may choose to write their own brief. All briefs must be loaded prior to the hearing date to the List of Documents section.
Fee Agreement (Sent TO Contractor)
A Fee Agreement (Sent TO Contractor) must be loaded for each claimant put on the Assure calendar. This document is vital to obtain any of the rewarded fees after the hearing. The firm must upload the “Fee Agreement Sent TO Contractor” so the attending attorney can take it with them to the hearing for the claimant to sign.
Fee Agreement (Sent FROM Contractor)
A Fee Agreement (Sent FROM Contractor) must also be loaded for each claimant on the calendar following the hearing. This document is vital to obtain any of the rewarded fees after the hearing. Following the hearing, the attending attorney must reload the fee agreement that was signed by the claimant and by them (the attorney) at the hearing. The file should be reloaded to the Assure Portal and labeled “Fee Agreement Sent FROM Contractor”.
Form 1696 (Sent TO Contractor)
The Firm attaches this form for the attending attorney to the List of Documents on the Hearing Details screen. The attending attorney will print out this form and take it with them to the hearing so the claimant can sign it.
Form 1696 (Sent FROM Contractor)
The attorney must take the 1696 to the hearing so the claimant can sign it. When both the attorney and the claimant have signed it, the attending attorney will reload the signed document to the Assure portal under the List of Documents on the Hearing Details screen. The signed 1696 must be reloaded and labeled as Form 1696 Sent FROM Contractor.
Notice of Hearing
All firms in the network must supply a notice of hearing for each active entry in the calendar. We realize that hearings will take place in the same general location most of the time, but sometimes there will be revisions made to the hearing location due to VTC hearings, build renovations, or one ODAR location opening two offices due to the increase of hearings in a given region.
