Prevail 10 E-Training*: Negotiation Tab

The Negotiation Tab in Prevail is a powerful tool for tracking offers and demands, calculating settlement details, and managing liens for the matter.

Part 1: Adding Offers and Demands

  1. Click 'Add Demand' or 'Add Offer'.

  2. Enter information in the following fields:

    1. Subject: Enter a description of the entry. Example: Offer 1

    2. Type: This will automatically be filled out depending on whether you clicked 'Add Demand' or 'Add Offer.'

    3. Automates to the current date, or you may select the date of the demand or offer, if needed.

    4. (checkbox) Check this box if it is the final demand or offer.

    5. Notes: Enter any notes in this text box.

Part 2: Settlement Calculator

  1. Click ‘Add Demand’ or ‘Add Offer’.

  2. Enter the amount of the offer or demand in the Amount field.

  3. The firm’s default percentage share of the settlement will display in the Percent field.

    1. This default percent is based on the law type for the case. For more information, see Prevail 10 E-Training*: Law Type/Case Type/Contact Type Setup.

    2. You may change this percentage as necessary in each offer and demand entry window.

  4. If your firm’s costs are to be subtracted first, Check the ‘Costs subtracted first’ box.

  5. If damages are to be subtracted, check the 'Subtract damages' box.

  6. Prevail will automatically display the total of all costs from the Ledger in the Costs field, total liens from the lower-half of the Negotiations tab in the Liens field, and total damages from the Damages tab in the Damages field.

    1. Note: The category assigned to a Ledger Cost or Damage entry determines whether that entry is included in the settlement calculator. When you set up your Cost and Damage categories in the Databank, check the ‘Include in Settlement Calculator’ box for any categories you wish to include. Entries that are uncategorized will not be included in the calculator. The Damages balance is used in the calculator, not the total damages incurred.

  7. Note: If you want to determine what the settlement amount must be in order for the client to net a certain dollar amount, you can enter the client’s desired net settlement amount in the Client field, and Prevail will calculate and display the necessary settlement amount in the Amount field.

Part 3: Adding Liens

  1. Click ‘Add’ in the Lien section of the tab.

  2. Enter a brief description of the lien in the Subject field.

  3. Enter the lien date in the Entry Date field.

  4. Attach the lienholder in the provider field:

    1. Click the paper clip

    2. Search the provider’s name in the Contacts

    3. If the provider’s name appears in the list of search results

      • Double-click on it to attach

    4. If the provider’s name does not appear

      • Click ‘New’ at the top of the Contacts search window

      • Add provider to your contacts

      • Double-click to attach it to the lien entry

  5. Enter the policy number in the proper field.

  6. Enter the insured amount in the proper field.

  7. Enter the lien amount in the proper field.

  8. If a lien notice has been received, Check the ‘Received Notice’ box.

  9. Enter additional information in the Notes field.

  10. Click ‘Save’.
